These Terms of Service ("Terms") govern your access to and use of the Sayank website (sayank.com), mobile application, and related services (collectively, the "Service"), operated by Sayank ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
Sayank is a construction project management platform for residential builders and investors. It provides tools to track projects, budgets, expenses, draws, timelines, documents, and to collaborate with team members such as general contractors, lenders, and accountants. Features and functionality may change, be added, or be removed over time.
The Service is currently offered on an early-access basis and is provided free of charge. It may contain bugs, incomplete features, or limitations, and may be modified, interrupted, or discontinued at any time. We may introduce paid plans in the future; if we do, we will provide notice before any charges apply to your account.
You must provide accurate information and are responsible for maintaining the security of your account and for all activity that occurs under it. Authentication is provided through Auth0; you are responsible for safeguarding your login credentials. You must be at least 18 years old and able to form a binding contract to use the Service. Notify us promptly of any unauthorized use of your account.
You agree not to: (a) use the Service for any unlawful purpose or in violation of these Terms; (b) attempt to gain unauthorized access to the Service, other accounts, or our systems; (c) interfere with or disrupt the integrity or performance of the Service; (d) upload malicious code or content that infringes the rights of others; (e) reverse engineer or resell the Service except as permitted by law; or (f) use the Service to store or transmit data you do not have the right to process.
You retain ownership of the project, financial, document, and other content you submit to the Service ("Your Data"). You grant us a limited license to host, process, and display Your Data solely to operate and provide the Service to you and the collaborators you invite. You are responsible for the accuracy and legality of Your Data and for having the rights necessary to submit it. Our handling of Your Data is described in our Privacy Policy.
The Service provides tools and calculations (including budgets, pro forma, cash-flow, and tax summaries) for informational purposes only. It does not constitute financial, investment, accounting, tax, or legal advice. You are responsible for verifying all figures and for consulting qualified professionals before making decisions. We are not liable for decisions made in reliance on the Service.
The Service integrates with third parties (for example, Auth0 for authentication, cloud storage and email providers, and optional bank-statement or receipt processing). Your use of those integrations may be subject to their own terms. We are not responsible for third-party services or their availability.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will not be lost. You use the Service at your own risk.
To the maximum extent permitted by law, Sayank and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred U.S. dollars (USD $100).
You agree to indemnify and hold harmless Sayank and its operators from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from Your Data, your use of the Service, or your violation of these Terms.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases; provisions that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute arising out of these Terms or the Service.
